2. Use of the Site

2.1 By using the Site, you agree to comply with all applicable Australian and New Zealand laws.

2.2 You may use the Site for personal, non-commercial purposes only. Prohibited activities include data harvesting, uploading harmful content, or attempting unauthorised access to our infrastructure.

3. Your Account

3.1 You must be 18 years of age or older, or be purchasing with the consent and supervision of a parent or legal guardian, to place an order on this website.

4. Orders and Promotions

4.1 Each order constitutes an offer to purchase products at the listed price (including GST and shipping).

4.2 Daily Deals & Flash Sales: Promotions are valid only for the time period specified (e.g., 24 hours ending at 9:00 AM). Offers cannot be applied retrospectively.

4.3 We strive for accuracy in images; however, your device’s display may not perfectly reflect the true colours of our low-tox silicone materials.

5. Acceptance and Fraud Prevention

5.1 We reserve the right to reject an order due to product unavailability, pricing errors, or suspected fraud.

5.2 Security Checks: Orders flagged as high-risk by our automated systems (e.g., mismatched billing/shipping or suspicious IPs) may be cancelled and refunded automatically to protect our customers.

6. Delivery and Shipping

6.1 We deliver to Australia and New Zealand.

6.2 Dispatch: We aim to dispatch orders within 2–5 business days. During peak sale periods, processing may take up to 10 business days. Engraved and personalised items are made to order and may take up to 2 extra weeks.

6.3 Risk: Title passes to you upon delivery. If you provide “Authority to Leave,” you accept all risk of theft or loss from the moment of delivery.

7. Order Cancellations

7.1 By Us: We may cancel orders if products are unavailable or contain errors. A full refund will be issued.

7.2 By You: If you request a cancellation before the order is shipped, a 5% administration fee applies to cover non-refundable transaction costs. Orders cannot be cancelled once dispatched.

8. Pricing and Payment

8.1 All prices are in Australian Dollars (AUD).

8.2 We accept Visa, Mastercard, PayPal, Afterpay, and Zip.

8.3 Gift Cards: Valid for 3 years from the date of issue. Non-transferable and not redeemable for cash.

9. Warranty and Returns

9.1 Manufacturer’s Warranty: We provide a twelve (12) month warranty against manufacturing defects in materials and workmanship. It does not cover normal wear and tear, accidental damage, or improper cleaning.

9.2 Change of Mind Returns: If you change your mind about a purchase, you may return the item within 14 days of delivery, provided it is unused, in its original condition and packaging. 9.3 Consumer Guarantees (Faulty or Not-As-Described Goods): Our products come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). If your item is faulty, unsafe, or significantly different from how it was described, you are entitled to a repair, replacement, or refund. The 14-day window and any restocking fee in clause 9.2 do not apply to ACL claims — there is no time limit on your statutory rights. 10. Intellectual Property

10.1 All content on this Site, including logos and designs, is the property of Kaally Pty Ltd. Reproduction without permission is prohibited.

10b. Limitation of Liability

To the maximum extent permitted by law, Kaally Pty Ltd’s total liability to you for any claim arising from your use of this website or purchase of our products is limited to the amount you paid for the relevant order. We are not liable for any indirect, incidental, or consequential loss or damage, except where such liability cannot be excluded under the Australian Consumer Law.
